{"id":6209,"date":"2020-05-04T03:58:39","date_gmt":"2020-05-04T01:58:39","guid":{"rendered":"http:\/\/east-sea.de\/?p=6209"},"modified":"2020-06-24T00:42:12","modified_gmt":"2020-06-23T22:42:12","slug":"english-experts-call-chinas-actions-in-east-sea-breaches-of-international-law","status":"publish","type":"post","link":"http:\/\/east-sea.de\/en\/2020\/05\/04\/english-experts-call-chinas-actions-in-east-sea-breaches-of-international-law\/","title":{"rendered":"Experts call China\u2019s actions in East Sea breaches of international law"},"content":{"rendered":"<em>Experts have condemned China\u2019s recent actions in the East Sea, saying its moves have escalated tensions in the region and infringed upon international law.<\/em><\/p>\n<p>Talking to the Vietnam News Agency (VNA), Derek Grossman, a senior analyst at the US-based RAND Corporation, said there is general agreement that China has been bullying its neighbours with such moves, including Vietnam, the Philippines, and Malaysia.<\/p>\n<p>He believes that these acts may fuel security uncertainties in the region and even escalate tensions.<\/p>\n<p>James Rogers, Director of the Global Britain Programme at the UK-based Henry Jackson Society, told VNA that China\u2019s claim of sovereignty over almost the entire\u00a0<a href=\"https:\/\/en.vietnamplus.vn\/tags\/East-Sea.vnp\"><strong>East Sea<\/strong><\/a>\u00a0via the so-called \u201c<a href=\"https:\/\/en.vietnamplus.vn\/tags\/nine-dash-line.vnp\"><strong>nine-dash line<\/strong><\/a>\u201d is groundless and violates international law, especially the 1982 UN Convention on the Law of the Sea (UNCLOS).<\/p>\n<p><img loading=\"lazy\" class=\"alignnone  wp-image-6211\" src=\"http:\/\/east-sea.de\/datei\/uploads\/2020\/05\/china-300x198.jpg\" alt=\"\" width=\"365\" height=\"241\" \/><\/p>\n<div class=\"article-photo\"><em>A Chinese marine\u00a0surveillance\u00a0ship (Photo: AFP\/VNA)<\/em><\/div>\n<p>He held that the recent sinking of a Vietnamese fishing boat by a Chinese coast guard vessel in the vicinity of the Hoang Sa (Paracel) Archipelago was dangerous and unacceptable.<\/p>\n<p>China\u2019s unlawful sovereignty claims and excessive actions in the East Sea are undermining international law and causing insecurity in the region, he noted, adding that countries that comply with\u00a0<a href=\"https:\/\/en.vietnamplus.vn\/tags\/international-law.vnp\"><strong>international law<\/strong><\/a>\u00a0and those that play a major role in protecting the law-based international system need to condemn such actions.<\/p>\n<p>Meanwhile, the Russian news agency ANNA-News quoted experts in the country as describing China\u2019s recent naming of geographical features in the East Sea as a breach of international law.<\/p>\n<p>They said that according to the 1982 UNCLOS, states cannot claim sovereignty over an underwater object if it is not within 12 nautical miles of baselines. China\u2019s naming of islands, reefs, and features on the seabed of the East Sea is therefore groundless and violates international law.<\/p>\n<p>ANNA-News also noted that, in recent years, China\u2019s creation of artificial islands and development of infrastructure in the waters have faced international discontent.<\/p>\n<p>Russian specialists earlier condemned China\u2019s declaration of the establishemtn of two districts within so-called \u201cSansha city\u201d, saying the move runs counter to international law.<\/p>\n<p>On the Times of India, journalist Rudroneel Ghosh wrote that China\u2019s establishment of \u201cXisha district\u201d (which in fact is Vietnam\u2019s Hoang Sa Archipelago) and \u201cNansha district\u201d (which is Vietnam\u2019s Truong Sa (Spratly) Archipelago) within so-called \u201cSansha city\u201d is a unilateral move and undermines regional stability.<\/p>\n<p>On April 19, Ministry of Foreign Affairs spokeswoman Le Thi Thu Hang stated that: \u201cVietnam has strongly affirmed many times that it has sufficient historical evidence and legal foundation testifying to its sovereignty over the Hoang Sa and Truong Sa Archipelagos.\u201d<\/p>\n<p>She highlighted Vietnam\u2019s consistent viewpoint that it strongly objects to\u00a0the establishment of so-called \u201cSansha city\u201d and related actions, as they have seriously violated Vietnam\u2019s sovereignty, been valueless, unrecognised, and not beneficial to friendship among countries, and have complicated the situation in the East Sea, the region, and the world.<\/p>\n<p>\u201cVietnam demands that China respect Vietnam\u2019s sovereignty, abolish wrongful decisions made relating to these moves, and not commit similar acts in the future,\u201d the spokesperson added.<\/p>\n<p>Meanwhile, talking to Vietnam News Agency correspondents in New York, Dr Vu Quang Viet, former head\u00a0of the\u00a0National Accounts Division of the UN, said China had clearly taken provocative actions in the sea, and faced opposition from many countries worldwide, especially the US.<\/p>\n<p>Viet said among the above-mentioned actions were a Chinese marine surveillance ship&#8217;s sinking of a\u00a0<a href=\"https:\/\/en.vietnamplus.vn\/tags\/Vietnam.vnp\"><strong>Vietnam<\/strong><\/a>ese fishing vessel near the Paracel (Hoang Sa) archipelago, sending Haiyan Dizhi 8 into Vietnam&#8217;s exclusive economic zone (EEZ), unreasonable sovereignty claims over Vietnam\u2019s Paracel and Truong Sa (Spratly) archipelagos, and the issuance of the so-called \u201cstandard names\u201d for 80 entities in the East Sea.<\/p>\n<p>According to him, the US State Department and Department of Defence and American lawmakers have condemned China&#8217;s actions, saying they are illegal and harm countries in the region. The Philippine Foreign Ministry also expressed its solidarity and support for Vietnam on the issue.<\/p>\n<p>In face of this, the Vietnamese Government has repeatedly sent notes to the UN to oppose China\u2019s claims and sovereignty violations in the\u00a0<a href=\"https:\/\/en.vietnamplus.vn\/tags\/EAST-SEA.vnp\"><strong>East Sea<\/strong><\/a>, Viet said.<\/p>\n<p>Meanwhile, Prof Ta Van Tai from Harvard University emphasised that\u00a0<a href=\"https:\/\/en.vietnamplus.vn\/tags\/China.vnp\"><strong>China<\/strong><\/a>&#8216;s recent actions are provocative towards Vietnam&#8217;s sovereignty in the East Sea and contrary to\u00a0<a href=\"https:\/\/en.vietnamplus.vn\/tags\/UNCLOS-1982.vnp\"><strong>UNCLOS 1982<\/strong><\/a>.<\/p>\n<p>He said that China\u2019s claim of sovereignty over almost the entire East Sea via the so-called \u201cnine-dash line\u201d is groundless, and violates maritime sovereignty of other countries as clearly stated in the convention.\/. &#8211; VNA\n<p>Aufrufe: 396<\/p>","protected":false},"excerpt":{"rendered":"<p>Experts have condemned China\u2019s recent actions in the East Sea, saying its moves have escalated tensions in the region and infringed upon international law.
